I would like to take this opportunity to give you our thirty-sixth monthly update on the project.

General Status:
The consultant (Argus) completed the pilot test this month and a pilot rest report was received here at Orange County this morning. The pilot test was purposed for evaluating air sparging with vapor extraction in the area where concentrations are not reducing as fast as we’d like. The cleanup has been successful in all the areas it has occurred except for the area around monitoring well AW-10/MW-5/AW-26, which is a limited area along the sidewalk in front of the former Sellers Auto (the green building). The next step is for Argus to submit a Remedial Action Plan Modification for the design of the system modification. The step after that is for Argus to submit construction drawings and a bid package to perform the work. It is hard to anticipate the time it will take for the implementation to be started up, but we imagine it would polish off this area in one or two quarters at the most, once it is installed and turned on.

During the time all of the supplemental assessment, pilot test planning and pilot testing have been going on, the system has been operational. When the Remedial Action Plan Modification and construction occurs, the system will also continue to be operational. There is no need to cease operation of the system while this occurs because contaminant mass continues to be removed from the subsurface.

The cleanup goal is a four-year active phase remediation term plus an additional year of post active monitoring. We are striving to finish early and not have the system run for the full four years. I believe the use of air sparging/soil vapor extraction in front of the former Sellers Auto will allow that to happen. The most recent operation and maintenance report received by Orange County is the Year Three, Quarter Two (Tenth Quarter) Report. We are 63% through with the planned active remediation period by using the number of reports submitted. The system started up in February 2007 and has been operational, save for the downtime, for about two years and eight months or almost 11 of the 16 quarters planned. The tentative date that we would expect to be finished with active remediation is January or February 2011, and completing post active remediation monitoring shortly after February 2012. Again, we will continue to strive to beat these deadlines.

System Runtime:
The system runtime during this quarter was less than the required 80% with the major cause of downtime attributed to the system being shut down due to the significant rains during this period. There has been a lot of downtime since startup in February 2007 for various reasons discussed in past updates. The current cause of downtime reported by Argus is that the infiltration gallery, where the treated water is put back into the ground is. Argus states that beginning in April 2009, rainfalls have been very high and we have received 11 inches more rain than average. The infiltration gallery can’t keep up with the rainfall and percolating treated water fast enough. The infiltration gallery was to be designed to keep up with the highest rain events, but we are seeing this isn’t the case. We can expect better efficiency now though as we are entering the dry season.

Throughput:
· Groundwater: Between February 2007 to August 2009, 14.2 million gallons of water have been treated. The rate per month or per quarter has been variable, but during the last three months report, which was from the end of May to the end of August the amount was almost 1.6 million gallons.
· Vapors: The air samples collected for the last six months have been below laboratory detection limits. Although some petroleum mass is still be extracted both from the groundwater and from the vapors, the mass has almost completely diminished. We expect to see more mass recovery when we begin air sparging in front of the former Sellers Auto.

Maintenance of the Equipment:
Below are maintenance items that we understand Argus recently addressed:
· There were some broken flow meters that were recently corrected.
· An air filter for the SVE system was several months overdue to be changed, but was recently changed.
· This is not a maintenance issue, but the oxidizer that hasn’t been needed in about a year is planned to be moved to a site in Brevard County in early 2010. This won’t affect the system operation. This will allow room for the carbon to be put back before the air sparging begins.

Report Status
The Year 3, Quarter 2 Operation & Maintenance Report was received October 28th and is being reviewed now. I briefly looked though the Pilot Test Report this morning and will complete my review of it very soon. The next report I will receive from Argus is the Year 3, Quarter 3 Operation & Maintenance Report, which is due on December 31, 2009, but we expect Argus will be able to submit this one earlier.

The Remedial Action Plan Modification is due December 30, 2009.

Milestone Update:
The most recent groundwater sampling data is from August 28, 2009, which was discussed in my last update. All performance measurement key monitoring wells except for one of them are meeting milestones. From the last update:

The approved RAPMod stated that the goals for this site are 90% reduction for the chemicals of concern (COC) to contaminant target levels (CTLs). Of the 12 monitor wells sampled, the following eight monitor wells: AW-3, AW-7, AW-11, AW-18, AW-22, AW-24, AW-25, and MW-6 currently are below Chapter 62-777, F.A.C., Table 1 Groundwater Cleanup Target Levels for all COCs analyzed. The remaining monitor wells: AW-10, MW-5, MW-9, and DW-11, had COCs above the CTLs. Of the four monitor wells with COCs currently exceeding CTLs, only one well (MW-5) is not meeting the milestones. In the last four or five quarters we hit a plateau with contaminants in a couple of monitoring wells near the sidewalk of the former Sellers Auto site is not reducing as rapidly as we’d like.

I would like to take this opportunity to give you our thirty-fifth monthly update on the project.

General Status:

The new work order to perform the pilot test and prepare the Remedial Action Plan Modification has been approved and Argus will very soon be scheduling the pilot test.

The system runtime during this quarter was less than the required 80% with the major cause of downtime attributed to the system being shut down due to the significant rains during this period. Argus reports that the saturated conditions in the vicinity of the gallery represent conditions out of their control. According to the historical weather reports for the month of May 2009, Orlando experienced excessive rainfall with as much as approximately 14 inches of rainfall, 10 inches above normal for that month. Between May and August 2009, the rainfall documented was over the historical averages for that period.

The amount of water treated between May and August was 1.58 million gallons, which is only a little lower than the range of groundwater treatment volume we have been seeing in recent quarters (approximately 1.6 to 2.4 million gallons per quarter). Several of the wells shut off where Groundwater Cleanup Target Levels were already reached.

Maintenance to the equipment is ongoing and Argus is working to resolve a problem with the system having the versatility to use either of the two vacuum blowers, to balance the use of each. During most of the life of the cleanup only one of the two vacuum blowers has been used. It isn’t feasible to operate both at the same time and it is best that the hours of each are balanced so both are being used and maintained.

Report Status
The Year 3, Quarter 2 Operation & Maintenance Report is due at the end of October, and Argus should have it to us any day now. Today, I received the data through E-Mail that will be contained within this report and will summarize it in the milestone update below.

Milestone Update:

Since the samples were collected with the remediation system operating, Argus believes that the groundwater elevations within the monitor wells were lower than the last sampling event and that this may cause the water table to be exposed to the smear zone and therefore, allow the COCs to leach into the water table from the surrounding exposed aquifer matrix. The may be one of the causes of the increase in COC concentrations at MW-5 in addition to the previously reported findings that there is additional contamination upgradient of MW-5 that might be sourcing this area. The key milestone monitor wells being monitored include: AW-3, AW-7, AW-11, AW-22, AW-24, and MW-5. An Air Sparge/Vapor Extraction pilot test is soon to be performed in addition to a Level 3 Remedial Action Plan Modification to implement system modifications that will address the additional contamination.

I would like to take this opportunity to give you our thirty-fourth monthly update on the project.

General Status:
There hasn’t been any downtime since my last update that the county was made aware of, but I understand that there was some downtime related to storms. We still plan on implementing the pilot test and subsequent Remedial Action Plan Modification as soon as the work order is approved to do so. The new work order to perform the pilot test and prepare the Remedial Action Plan Modification is still pending FDEP approval. I had thought it would be funded when I returned to the office from vacation, but FDEP still hasn’t signed it. It should be signed in the next week or two though.

Report Status
There are no reports in house at this time that haven’t been reviewed. We just completed our review letter for the Year 3, Quarter 1 Operation & Maintenance Report received July 8, 2009, and will send it out to Argus Consulting later today. The Year 3, Quarter 2 Operation & Maintenance Report is due at the end of October, but Argus has promised that it will be received in late September. This next report will have updated groundwater data.

Milestone Update:
There’s no new milestone data for this update since the last quarterly sampling data performed on June 1st 2009. However, Argus will have new data soon that I may be able to share with you by the next update (October 1, 2009). This effort is part of the International Coastal Cleanup, which will take place the same day in 104 countries and 42 US states. During the 2008 event, more than 32,000 Floridians cleaned nearly 2,000 miles of shoreline and collected 409,000 pounds of garbage! Just in Orlando, 7,200 pounds of trash were removed from seven lakes by 520 volunteers! Hats off to you!

I would like to take this opportunity to give you our thirty-second monthly update on the project.

Report Status / General Status:

* I note from a preliminary copy of the upcoming report that during last 100 of that period (ending on May 27th), only a 64% run time was achieved. All of the down time was related to a alarm on the control panel “critical high level in infiltration gallery” due to too much of a throughput of water. I understand we lost approximately 2 weeks of run time since then as well resulting from recent heavy rainfall events.

* Multiphase wells- Groundwater recovery wells: The optimization strategy now is to leave off MPE (groundwater recovery) wells #15 through #22 (leaving on MPE points # 1 though #14, #23 and #24. This is only a slight variation of what it was last month.

* Multiphase wells- Vapor recovery wells: All 24 of them are running. I think we would be better off turning some of them off, but Argus has explained to me that without a large enough total air flow volume, there is a backpressure problem with the blower that drives the vapor extraction. The blower is equipped with a bleed air valve for this, but opening this bleed valve will increase the noise the system produces. The strategy so far has been to give the blower the air it requires from the subsurface treatment points (all 24 of them) instead of using bleed air. The only problem with this, is the high water table is causing too much water recovery (from the groundwater recovery portion and the unintentional water from the vapor recovery) which causes the system to be periodically shut down. Argus may further explore the idea of using partial bleed air and to shut off some MPE vapor wells.

* Treatment points MPE-3, MPE-4 and MPE-5 are still being maximized for treatment around the area of MW-5.

* The floor of the equipment building on the air compressor side has been repaired since the last update. We noticed a different area of the building where the floor has also been damaged, which will need to be repaired later.

* We have the cost proposal in house now (received 06/29/09) and will be putting together a work order very soon to be funded by the FDEP. The Year Three, Quarter One Operation and Maintenance Report, but have not received it yet. It is not due until July 30, 2009, but we are expecting it earlier. Today I received a preview of the tables including the milestones.

After the Year Three Quarter One report (due July 30th), the next one is due October 30th and it too should be submitted a little earlier. Overall, we are about 2.4 yrs into our 4 year cleanup without factoring in the downtime we had from oxidizer approval and noise issues.

Milestone Update:

The new milestone data comes from the last quarterly sampling event performed on June 1, 2009. AW-3, AW-7, AW-11, AW-22, & AW-24 are meeting milestones. MW-5 is NOT meeting milestones.

o AW-11, AW-22, and AW-24 have completely cleaned up – met Groundwater Cleanup Target Levels (GCTL).

AW-11 has been clean for four consecutive quarters
AW-22 has been clean for six consecutive quarters
AW-24 has been clean for four quarters but only sampled three times since July ‘08

o AW-3 has completely met CTL for the first time. It had been passing milestones, and now it has completely met cleanup criteria for all petroleum constituents. We will need to cautiously watch this well though becomes the reduction trend since system startup hasn’t been very linear and has actually gone up and down with respect to Ethylbenzene and Total Xylenes concentrations. So we will watch it for potential rebound, which I don’t believe would be significant. Still, it is completely clean now.

o AW-7 has completely met CTL for the second consecutive quarter. I think this well has less potential for rebound than AW-3.

o MW-5 has not been meeting milestones for a long time now. Argus has documented this to us and mentioned on most of the last summaries for the last year or so, a remedial action plan modification is still needed to treat this area more affectively. The pilot test will be performed in this area and will give Argus the data they need to design and implement a modification here using air sparging and soil vapor extraction. Many of the contaminants failing milestones in this well show concentrations above baseline level.

o AW-10 is another well (though not currently a performance measurement key well) that will need to be addressed because this well has levels of contaminants similar to MW-5. The levels of contaminants found during the June 1, 2009 sampling event are very similar to what was found during the February 25, 2009 sampling event. This well is near MW-5 located near the former Sellers Auto side of the project, where the pilot test is proposed. AW-26 and AW-27 (last sampled in March 2009) are new wells and weren’t scheduled to be sampled this time. They were installed and sampled once so far. These are also in this same area where the pilot test and remedial action modification is needed another well (though not currently a performance measurement key well) that will need to be addressed because this well has levels of contaminants similar to MW-5. However, this well did not rebound nearly as bad as MW-5. This well is near MW-5 located near the former Sellers Auto side of the project.
